PA, Berks Co., Deed Book 4, pp. 75-77 Deed, dated 16 May 1763 Grantors: Abraham Stauffer and Christiana, his wife Grantee: Michael Keyser This indenture made the sixteenth day of May in the year of our Lord one thousand seven hundred and sixty three between Abraham Stauffer of Cumry Township in Berks County and Province of Pennsylvania yeoman and Christiana his wife of the one part and Michael Keyser of Heidelberg Township in the said county yeoman of the other part. Whereas David Jones and Lucy his wife by their indenture bearing date the first day of October in the year of our Lord one thousand seven hundred and forty five did grant sell release and confirm unto John Pugh a certain piece or parcel of land situate in the Township of Cumry aforesaid beginning as a black oak at a corner of other land of the said John Pugh thence extending by land of the said David Jones the seven following courses viz. south forty degrees east sixty three perches to a corner marked black oak and south fifty degrees west seventy perches a corner post and north ten degrees west thirty two perches to a corner post and south forty six degrees west nineteen perches to a corner marked chesnut and south thirty seven degrees east twenty six perches to a corner post and south fifty degrees west thirty perches to a corner marked hickery and north seventy nine degrees west forty six perches to a corner marked hickery thence north forty degrees east by other land of said Pugh one hundred and thirty six perches to the place of beginning containing thirty five acres and an half an acre of land besides the usual allowance of six acres per cent for roads and high ways & with the appurtenances to hold to him the said John Pugh his heirs and assigns in fee [it being part of a tract of two hundred and sixty four acres granted by patent from the honourable Proprietaries of the said Province to the said David Jones in fee] subject to the yearly quit rent of one half penny sterling for every acre of the same payable to the said Proprietaries their heirs and successors. Whereas the said Proprietaries by their patent or grant under the great seal of the said Province bearing date the twenty seventh of December in the year of our Lord one thousand seven hundred and fifty did grant and confirm unto the said John Pugh a certain tract of land situate in the Township of Cumry aforesaid beginning at a stone at a corner of Evan Lloyds land and from thence extending by vacant land south forty seven degrees west sixty five perches to a post thence by David Jones's land north forty degrees west one hundred and seven perches to a marked black oak south forty one degrees west one hundred and eighty perches to a post and north thirty degrees west one hundred and twenty perches to a marked hickery thence by land of Thomas Nicholas and John Jones north sixty degrees east two hundred and fifty perches to a stone thence by the said Evan Lloyd's land south fourteen degrees esast twenty seven perches to a stone south thirty degrees west twenty perches to a stone and south forty three degrees east one hundred and twenty perches to the place of begining containing one hundred and forty six acres and an allowance of six acres per cent for roads and high ways & with the appurtenances to hold to him the said John Pugh his heirs and assigns in fee subject to the yearly quit rent of one half penny sterling for every acre of the same payable to the said Proprietaries their heirs and successors as in and by the said patent recorded at Philadelphia in Patent Book A Vol. 15 page 583 ... relation being thereunto had at large appears. Whereas the said John Pugh by his indenture bearing date the twenty eighth day of April in the year of our Lord one thousand seven hundred and sixty one did grant release and confirm the said two tracts of land above described the one containing thirty thirty five acres and an half of an acre and the other one hundred and forty six acres of land as aforesaid with the appurtenances unto the said Abraham Stauffer in fee subject to the said quit rents aforesaid. Now this indenture witnesseth that the said Abraham Stauffer and Christiana his wife for and in consideration of the sum of thirteen hundred and twenty five pounds lawful money of Pennsylvania to them in hand well and truly paid by the said Michael Keyser at or before the sealing and delivery hereof the receipt. Whereas they the said Abraham Stauffer and Christiana his wife do hereby acknowledge and therefore acquit and for ever discharge the said Michael Keyser his executors administrators and assigns by these presents they the said Abraham Stauffer and Christiana his wife have granted bargained sold aliened enfeoffed released and confirmed and by these presents do grant bargain sell alien enfeof release and confirm unto the said Michael Keyser (in his actual and peaccable possession and ... now being) and to his heirs and assigns. All those the aforesaid two tracts pieces or parcels of land as the same is above set forth and described the one of them containing thirty five acres and an half of an acre and the other one hundred and forty six acres of land and allowance ... together with all and singular the houses out houses barns stables and other the buildings gardens orchards meadows fields pastures woods under woods waters water courses easements profits commodities advantages emoluments and hereditaments to the same tracts pieces or parcels of land belonging or in anywise appertaining and the reversions and remainders rents ... and profits of all and singular the said premises and every part thereof with the appurtenances and all the estate right title interest property claim and demand whatsoever of them the said Abraham Stauffer and Christiana his wife of in or to the same and every part thereof with the appurtenances to have and to hold the said two tracts of land and premises above hereby granted or mentioned or intended so to be and every part thereof with the appurtenances unto the said Michael Keyser his heirs and assigns to the only proper use and behoof of him the said Michael Keyser his heirs and assigns forever subject to the said yearly quit rents due and becoming due and payable for the said two tracts or parcels of land to the Chief Lord or Lords of the fee thereof. Whereas Valentine Keiser, father of the said Michael Keiser, by deed poll under his hand and seal bearing date the twenty third day of November Anno Domini 1762 did for the consideration therein mentioned grant bargain sell and convey unto the said Michael Keiser in fee the two first of three described tracts of land mentioned in a certain patent to him the said Michael Keiser dated the fifth day of February Anno Domini 1763 (recorded at Philadelphia in Patent Book AA Vol. 3 pa. 526) as in and by the said patent relation being thereunto had appears. But with the condition that he the said Michael Keiser would grant the tract of land herein after described to his the said Valentine Keiser's two grandchildren Michael Sommerladie and Valentine Sommerladie in fee or to some other person or persons in trust for them subject nonetheless to the dower of his daughter Catharine late widow of Jonas Sommerladie deceased now wife of Jacob Mohr of the Township of Heidelberg aforesaid yeoman. Whereas at an orphans court held at Reading in & for the said County of Berks the day of November Anno Domini 1763 John Heckhart of the said Township of Heidelberg sadler was appointed guardian of the said Michael Sommerladie and Valentine Sommerladie the minor children of the aforesaid Jonas Sommerladie deceased as in and by the records and proceedings of the said court appears. Whereas the honorable the Proprietaries of the Province aforesaid in and by their patent under the great seal of said Province bearing date the twenty fifth day of February in their year of our Lord one thousand seven hundred and sixty three for the considerations therein mentioned did grant and confirm unto the said Michael Keiser, party thereto, three several tracts of land situate in the Township of Heidelberg in the County of Berks aforesaid butted bounded and described as follows, to wit, the one of them beginning at a hickery standing on the bank of Tulpehoccon Creek thence south west twenty eight perches to a marked black oak thence south eighty degrees west seventy nine perches to a marked white oak thence south sixty four degrees west one hundred and twenty four perches to a post set for a corner (the three courses and distances aforesaid being by land surveyed to Hans George Minheer). To hold the said three several described tracts making together two hundred and two acres and thirty eight perches of land and premises by the said patent granted and confirmed to him the said Michael Keiser his heirs and assigns for ever (except certain parts of mines therein excepted and reserved) subject to the payment of one half penny sterling for every acre thereof to the Proprietary yearly for ever; as in and by the said recited patent recorded in in the office for recording of deeds for the City and County of Philadelphia in Pat. Now this indenture witnesseth that for an in consideration of the sum of seven hundred pounds lawful money of Pennsylvania to the said Michael Keiser and Mary his wife in hand well and truly paid by the said Ulrich Richardt at and before the ensealing and delivery hereof the receipt whereof they do hereby acknowledge and thereof do acquit and for ever discharge the said Ulrich Richardt his heirs executors and administrators by these presents they the said Michael Keiser and Mary his wife have granted bargained sold aliened enfeoffed released and confirmed. And by these presents do grant bargain sell alien enfeoff release and confirm unto the said Ulrich Richardt (in his actual possession now being) and to his heirs and assigns a certain tract piece or parcel of land (part of the lands above described) butted and bounded as follows, to wit. Whereas David Jones and Lucy his wife by their indenture bearing date the first day of October in the year of our Lord one thousand seven hundred and forty five, did grant sell release and confirm unto John Pugh a certain piece or parcel of land situate in the Township of Cumru aforesaid beginning at a black oak at a corner of other land of the said John Pugh, thence extending by land of the said David Jones the seven following courses viz. south forty degrees east sixty three perches to a corner marked black oak and south fifty degrees west twenty perches to a corner post and north ten degrees west thirty two perches to a post and south forty six degrees west nineteen perches to a marked chestnut and south thirty seven degrees east twenty six perches to a corner post and south fifty degrees west thirty perches to a marked hickory and north seventy nine degrees west forty six perches to a hickory and north seventy nine degrees west forty six perches to a marked hickory thence north forty degrees east by other land of said Pugh one hundred and thirty six perches to the place of beginning containing thirty five acres and an half of one acre of land besides the usual allowance of six acres.... for roads and high ways ... with the appurtenances to hold to him the said John Pugh his heirs and assigns in fee [It being part of a tract of two hundred and sixty four acres granted by patent from the then Proprietaries of Pennsylvania to the said David Jones in fee.] subject to the yearly quitrent of one half penny sterling for every acre of the same payable to the said Proprietaries there heirs or successors. Whereas the said Proprietaries by their patent or grant under the great seal of the then Province now state of Pennsylvania bearing date the twenty seventh day of December in the year of our Lord one thousand seven hundred and fifty did grant and confirm unto the said John Pugh a certain tract of land situate in the Township of Cumru aforesaid beginning at a stone a corner of Evan Lloyds land and from thence extending by vacant land south forty seven degrees west sixty five perches to a post, thence by David Jones's land north forty degrees west one hundred and seven perches to a marked black oak south forty one degrees west one hundred and eighty perches to a post, and north thirty degrees west one hundred and twenty perches to a marked hickory thence by land of Thomas Nichols and John Jones north sixty degrees east two hundred & fifty perches to a stone thence by the said Evan Lloyds land south fourteen degrees east twenty seven perches to a stone south thirty degrees west twenty perches to a stone and south forty three degrees east one hundred and twenty perches to the place of beginning containing one hundred and forty six acres and allowance of six acres percent for roads and highways ... with the appurtenances to hold to him the said John Pugh his heirs and assigns in fee subject to the yearly quitrent of one half penny sterling for every acre of the same payable to the said Proprietaries their heirs and successors as in and by the said patent recorded in Philadelphia in Patent Book A Vol. 15 Page 583 ... relation being thereunto had at large appears. Whereas the said John Pugh by his indenture bearing date the twenty eighth day of April in the year in the year of our Lord one thousand seven hundred & sixty one did grant release and confirm the said two tracts of land above described with the appurtenances unto Abraham Stauffer in fee subject to the quit rents aforesaid. Whereas the said Abraham Stauffer and Christiana his wife by their indenture dated the sixteenth day of May in the year of our Lord one thousand seven hundred and sixty three did grant and release confirm and make over the said above described two tracts of land the one containing thirty five acres and one half of an acre and the other one hundred and forty six acres of land as aforesaid with the appurtenances unto the said Michael Keyser, party hereto, in fee subject to the said quitrents aforesaid. Whereas Adam Householder by his indenture bearing date the ninth day of June in the year of our Lord one thousand seven hundred and seventy three did grant sell release and confirm unto the aforesaid Michael Keyser in fee the following described piece or parcel of land situate in Cumru Township aforesaid and contiguous to the above described tracts of land beginning at a stone in the middle of a great road commonly called Flying Hill Road, thence crossing the one half of said road and by land of George Rhiem east by north eighteen perches to a post thence by the said Rhiems said land north forty one degrees east ten perches to a post a corner of other land of the said Michael Keyser thence by the same and land of John Davies north thirty degrees west one hundred and sixty perches to a post a corner of land of Thomas Davis thence by the same south forty eight degrees west ninety three perches to a post in the middle of the aforesaid road thence along the same south fifty six degrees east ninety nine perches and one half and south fifty three degrees east fifty three perches to the place of beginning containing fifty three acres of land besides the usual allowance of six acres percent for roads and highways [it being part of a tract of one hundred and fifty acres and allowance of land which the Proprietaries of Pennsylvania by their patent dated the 20th day of November 1745 recorded in the Rolls Office in Patent Book A Vol. 12 page 267 ... to David Jones in fee who with Lucy his wife by their indenture made the 16th day of November 1746 recorded in the office for recording of deeds in and for the Coutny of Berks in Book A Vol. 2nd page 99 ... granted the same to James Hart in fee who with Rebecca his wife by their indenture made the 26th day of September 1748 recorded in the office of recording of deeds at Reading aforesaid in Book A Vol. 2nd page 181 ... granted the same to John Smith in fee who with Sarah his wife by their indenture dated the 18th day of November 1753 recorded in the office for recording of deeds at Reading aforesaid in Book A Vol. 2nd page 104 granted the same to the above mentioned Adam Householder in fee who by his indenture bearing date above mentioned recorded in the office for recording of deeds at Reading aforesaid in Book B, Vol. ... page 330 ... granted the same unto the above named Michael Keyser party hereto in fee.] Now this indenture witnesseth that the said Michael Keyser and Anna Maria his wife for and in consideration of the sum of two thousand seven hundred pounds in specie lawfull money of Pennsylvania to them in hand well and truly paid by the said Christian Gernand at and before the ensealing and delivery hereof the receipt thereof they the said Michael Keyser and Anna Maria his wife do hereby acknowledge and thereof acquit and forever discharge the said Christian Gernand his heirs executors administrators and assigns by their presents they the said Michael Keyser and Anna Maria his wife have granted bargained sold aliened enfeoffed released and confirmed and by these presents do grant bargain sell alien enfeoff release and confirm unto the said Christian Gernand and to his heirs and assigns all those the the aforesaid and described three tracts, pieces and parcels of land as the same is above set forth and described the one containing thirty five acres and an half of an acre of land and allowance ... together with all and singular the houses, out houses, barns, stables and other the buildings, gardens, orchards, meadows, fields, pastures, fencing, woods, underwoods, waters, watercourses, easements, profits, commodities, advantages, and hereditaments to the same tracts, pieces, or parcels of land belonging or in anywise appertaining and the reversions and remainders rents ... and profits of all and singular the said premises and every part thereof with the appurtenances and all the estate right title interest property claim and demand whatsoever of them the said Michael Keyser and Anna Maria his wife of in or to the same, and every part thereof with the appurtenances to have and to hold the said three tracts of land and premises above hereby granted or mentioned or patented so to be and every part thereto, with the appurtenances unto the said Christian Gernand his heirs and assigns to the only proper use and behoof of him the said Christian Gernand his heirs and assigns forever subject to the said yearly quitrents due and becoming due and payable for the said three tracts or parcels of land to the Chief Lord or Lords of the fee thereof, and the said Michael Keyser for himself and his heirs executors and administrators doth covenant promise and grant to and with the said Christian Gernand his heirs and assigns, that the said Michael Keyser and his heirs the said described three tracts pieces and parcels of land and premises hereby granted with the appurtenances unto the said Christian Gernand his heirs and assigns, against him the said Michael Keyser and his heirs and against all person or persons, whatsoever lawfully claiming or to claim any estate right title or interest therein or thereof by from or under him them or any of them shall and will warrant and fore ever defend by these presents and that he the said Michael Keyser, his heirs executors or administrators shall and will, at any time or time hereafter, at the reasonable request cost and charges of the said Christian Gernand his heirs or assigns make execute and acknowledge or cause unto be all and every such further or other lawfull and reasonable act or acts, deed or deeds, conveyance or assurance, in the law, whatsoever, for the further, better, more perfect, and absolute granting releasing and confirming, the said three tracts, pieces or parcels of land, hereditaments, and premises hereby granted or mentioned so to be with the appurtenances unto him the said Christian Gernand his heirs and assigns for ever, as by the said Christian Gernand his heirs and assigns, or his or their council learned in the law shall be lawfully, devised advised or required.
